NOMINATION OFCANDIDATE FOR CONFIRMATION AS DEPUTY PRESIDENT

PRESIDENTIAL MEMORANDUM OF NOMINATION

By HIS EXCELLENCY, THE HONOURABLE WILLIAM SAMOEI RUTO, Ph.D., CGH., President and Commander-in-Chief of the Kenya Defence Forces.

Submitted to the NATIONAL ASSEMBLY OF KENYA, through the HONOURABLE SPEAKER OF THE NATIONAL ASSEMBLY.

WHEREAS, Article 150 of the Constitution, as read together with Articles 144 and 145, provides the grounds and process for the removal of a Deputy President from Office;

WHEREAS, Pursuant to Article 150 of the Constitution, a vacancy has arisen in the Office of Deputy President, as notified in Kenya Gazette Notice No. 13400 of 17th October, 2024, following the resolution of the Senate;

WHEREAS, Article 149 of the Constitution sets out the process of filling of a vacancy in the office of Deputy President as follows:

"Within fourteen days after a vacancy in the office of Deputy President arises, the President shall nominate a person to fill the vacancy, and the National Assembly shall vote on the nomination within sixty days after receiving it." [Emphasis]

WHEREAS, As a prerequisite to the nomination, I sought and received confirmation from the Independent Electoral and Boundaries Commission (IEBC) that the Candidate herein is qualified to vie for election as a Member of Parliament in accordance with Article 137(1) of the Constitution;

WHEREAS, Chapter Six of the Constitution establishes the guiding principles of leadership and integrity for individuals entrusted with managing public affairs;

WHEREAS, These constitutional safeguards form the framework for assessing the fitness and propriety of individuals holding State Office; and

WHEREAS, In consideration of the aforementioned constitutional and statutory requirements on integrity, ethics, and moral fitness for individuals entrusted with State Office; I have sought and received clearances from the Kenya Revenue Authority (KRA), the Ethics and Anti-Corruption Commission (EACC), the Directorate of Criminal Investigations (DCI), the Higher Education Loans Board (HELB), and the Commission for University Education (CUE) with respect to the Candidate herein.

NOW THEREFORE, I, WILLIAM SAMOEI RUTO, President and Commander-in-Chief of the Kenya Defence Forces, pursuant to Article 149(1) of the Constitution, do hereby nominate PROF. KITHURE KINDIKI, Ph.D., EGH, for consideration and confirmation through a vote of the National Assembly to be the next Deputy President of the Republic of Kenya.

FOR REASONS WHEREOF, I hereby enclose the following documents in relation to the nominee:

1. Certified true copy of his Certificate of Birth;
2. Certified true copy of his National Identity Card;
3. Certified copies of his University Degrees and other Academic Certificates;
4. Certification of foreign university degrees by the Commission for University Education (CUE);
5. Passport-size Photograph;
6. Curriculum Vitae and Testimonials;
7. Confirmation of Compliance with Article 137 of the Constitution from the Independent Electoral and Boundaries Commission (IEBC);
8. Confirmation of Citizen Status by the National Registration Bureau (Office of the Registrar of Persons);
9. Confirmation of Membership Status in a Political Party from the Office of the Registrar of Political Parties (ORPP).
10. Political Party Membership Confirmation from the United Democratic Alliance (UDA);
11. Chapter Six of the Constitution - Statutory Clearances (Leadership and Integrity) from:
    a) Tax Compliance Certificate - Kenya Revenue Authority (KRA);
    b) Ethics and Anti-Corruption Commission (EACC);
    c) Certificate of Good Conduct - Directorate of Criminal Investigations (DCI);
    d) Compliance – Higher Education Loans Board (HELB); and
    e) Credit Report and Certificate of Clearance - Credit Reference Bureau (CRB).

IN TESTIMONY WHEREOF, I have caused this Presidential Memorandum of Nomination to be issued under the HAND OF THE PRESIDENT and the PUBLIC SEAL OF THE REPUBLIC, on this the Eighteenth Day of October in the YEAR OF OUR LORD TWO THOUSAND AND TWENTY-FOUR.
